Labor Shortage Terms and Agreements

1. User Responsibilities
All users, whether laborers or those seeking labor, are required to:
- Provide accurate, current, and truthful information during registration and in all interactions on the platform.
- Refrain from misrepresenting qualifications, skills, job details, or any other information that could impact other users.
- Conduct all communications and transactions in a professional and respectful manner.
2. Account Use and Termination
- Account Creation: Users may create a single account. Multiple accounts for the same individual or entity without explicit permission from Labor Shortage are prohibited.
- Termination: We reserve the right to terminate or suspend accounts at our discretion for violations of these terms, fraudulent behavior, spamming, or inappropriate conduct.
- Account Deletion: Users can request to delete their accounts by contacting support at contact@laborshortage.la. Account deletion requests are subject to our account deletion policy, ensuring no unresolved disputes or outstanding payments.
3. Payments and Refunds
- Payment Handling: Payments are processed through third-party platforms. Labor Shortage provides a secure environment for transactions but does not directly handle payments.
- Refunds: Refunds are governed by the terms agreed upon between laborers and employers. Labor Shortage encourages clear communication to resolve payment disputes amicably and will not mediate or enforce refunds.
4. Dispute Resolution
- Labor Shortage does not mediate labor agreements or disputes between users. Users are encouraged to communicate directly to resolve conflicts.
- For unresolved disputes, users may consider external mediation or legal action. Labor Shortage assumes no liability for disputes between users and will not provide legal mediation services.
5. Content and Intellectual Property
- User-Generated Content: Users are responsible for the content they post on the platform, including job listings, resumes, and comments. By uploading content, users grant Labor Shortage a license to use, display, and distribute the content as necessary to provide and promote the service.
- Ownership: All content created by Labor Shortage (including text, graphics, and software) is the property of Labor Shortage and protected by copyright law.
- Third-Party Content: Some content on the platform may come from third-party sources. Labor Shortage is not responsible for the accuracy or legality of third-party content. Users should exercise caution when engaging with third-party information or links.
6. Prohibited Conduct and Objectionable Content
Labor Shortage enforces a strict zero-tolerance policy regarding objectionable content and abusive behavior. Examples include but are not limited to:
- Posting discriminatory, hateful, or offensive language or material.
- Engaging in harassment, threats, or intimidation of other users.
- Sharing false or misleading information to deceive others.
- Uploading content that is illegal, obscene, or violates intellectual property rights.
Violations may result in immediate account suspension or termination and, if necessary, reporting to relevant authorities.
7. Liability Disclaimer
- No Guarantees: Labor Shortage does not guarantee the quality of work provided by laborers or the accuracy of job postings. We provide a platform for users to connect.
- Limitation of Liability: Labor Shortage is not liable for any damages, losses, or injuries resulting from the use of the platform, including but not limited to lost earnings, property damage, or personal injury.
- Indemnity: Users agree to indemnify and hold harmless Labor Shortage, its employees, and affiliates from any claims or damages resulting from their use of the platform or violation of these terms.
8. Privacy and Data Security
- Data Collection: Information provided by users is subject to our Privacy Policy. Sensitive information will not be shared with third parties without user consent unless required by law.
- User Privacy: Users have the right to request access to their data, request deletion of their data, or request correction of inaccurate data. Labor Shortage may retain data as required by law or for legitimate business purposes.
- Cookies: We use cookies to enhance user experience and analyze usage patterns. Users may disable cookies through their browser settings, but this may affect platform functionality.
9. Changes to Terms
Labor Shortage reserves the right to modify these terms and conditions at any time. Users will be notified of changes via email or in-app notifications. Continued use of the platform after such updates signifies acceptance of the updated terms.
10. Governing Law
These terms shall be governed and construed in accordance with the laws of the State of California. Any disputes arising from the use of the platform will be subject to the exclusive jurisdiction of the courts located in California.
