Labor Shortage Terms and Agreements

Effective Date: 21st December 2023

1. User Responsibilities

All users are required to:

  • Provide accurate, current, and truthful information during registration and while using the platform.
  • Use the app solely for legitimate project management purposes.
  • Maintain the confidentiality of their account credentials.
  • Refrain from uploading false project information, quotes, or any misleading content.

2. Account Use and Termination

  • Account Creation: Users may create only one account per individual or business. Multiple accounts without explicit permission from Labor Shortage are prohibited.
  • Termination: We reserve the right to suspend or terminate accounts at our discretion for violations of these terms, fraudulent activity, or inappropriate conduct.
  • Account Deletion: Users may request deletion of their account by contacting support at contact@laborshortage.la
  • Deletion requests are subject to our data retention policy.

3. Platform Purpose and Usage

Labor Shortage is a free project management tool designed for trade contractors. The platform allows users to organize projects, create and send quotes, manage project items and tasks, and centralize project-related information. It is not intended as a general social network or payment processing service.

4. Payments and Quotes

  • The app enables users to create and send professional quotes. Any financial transactions or agreements made outside the platform (e.g., with clients) are solely between the user and their client.
  • Labor Shortage does not process payments, hold funds, or act as an escrow service. We are not responsible for payment disputes between contractors and their clients.

5. Dispute Resolution

Labor Shortage does not mediate disputes between users and their clients, suppliers, or any third parties. Users are responsible for resolving all business and contractual disagreements independently. Labor Shortage assumes no liability for any disputes arising from projects managed on the platform.

6. Content and Intellectual Property

  • User-Generated Content: You retain ownership of the content you upload (projects, quotes, tasks, documents, etc.). By using the platform, you grant Labor Shortage a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content as necessary to provide the service.
  • Labor Shortage Content: All software, designs, logos, and original content provided by Labor Shortage are owned by us and protected by copyright and intellectual property laws.
  • You may not copy, modify, or distribute our content without permission.

7. Prohibited Conduct

You agree not to:

  • Misrepresent your business, qualifications, or project details.
  • Upload illegal, offensive, discriminatory, or harmful content.
  • Attempt to reverse engineer, hack, or interfere with the platform.
  • Use the app to send spam, harass other users, or engage in fraudulent activities.
  • Violate any applicable laws or regulations.

Violations may result in immediate account suspension or permanent termination.

8. Liability Disclaimer

  • No Guarantees: Labor Shortage provides a project management tool “as is.” We do not guarantee project outcomes, client satisfaction, or business results.
  • Limitation of Liability: To the fullest extent permitted by law, Labor Shortage shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.
  • Indemnity: You agree to indemnify and hold Labor Shortage harmless from any claims, losses, or damages resulting from your use of the platform or violation of these terms.

9. Privacy and Data Security

Your use of Labor Shortage is also governed by our Privacy Policy. We take data security seriously and implement reasonable measures to protect your information. By using the app, you consent to the collection and use of data as described in the Privacy Policy.

10. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify users of material changes via email or in-app notification. Continued use of the app after such changes constitutes your acceptance of the new terms.

11. Governing Law

These terms shall be governed by the laws of the State of California, United States. Any disputes shall be resolved exclusively in the courts located in California.
